Terms of Service
Timberline Voice · Effective date: October 13, 2026
These Terms are an agreement between you (the business signing up, "Client," "you") and Timberline Voice ("we," "us"), Proven Rise LLC, Colorado Springs, Colorado. By starting a trial or using our service you agree to them. If you don't agree, don't use the service.
1. The service
We build, set up, and manage custom AI phone operators ("Agents") that answer calls for your business, take messages, qualify jobs, book appointments, flag urgent calls, and send you summaries. Plan features and included minutes are listed on our pricing page or your order.
2. AI voice and disclosure
Agents use AI-generated voices, powered by third-party AI providers. Every Agent will tell callers it is an AI at the start of each call and whenever asked. You may not ask us to remove, hide, or weaken this disclosure. This supports compliance with Colorado HB26-1263 and other AI-disclosure laws.
3. Free trial, card on file, and automatic conversion
- New clients get a 3-day trial. A valid payment card is required at signup through Stripe.
- Unless you cancel before the trial ends, your trial automatically converts to the paid plan you selected, and we will charge your card the setup fee (if any) and first month's fee on the conversion date. Recurring monthly (or annual) charges continue until you cancel.
- We'll remind you before the trial ends. You can cancel anytime during the trial at no charge by using the cancel link in your signup email, emailing jodyp@timberlinevoice.com, or calling (719) 496-4633.
- One trial per business.
4. Billing, overages, cancellation
- Fees are billed in advance through Stripe. Usage above your included minutes is billed at your plan's published overage rate the next billing cycle. We'll alert you as you approach your limit.
- Plans are month-to-month. Cancel anytime; cancellation takes effect at the end of the current billing period, and you keep service until then. Fees already paid, including setup fees, are non-refundable except where required by law or at our discretion.
- We may change prices with at least 30 days' email notice; changes apply at your next renewal.
- Failed payments may result in suspension after notice.
5. No guarantee of answering every call
We work hard to keep Agents reliable, but we do not guarantee that every call will be answered, answered at a particular speed, or handled correctly. Service depends on phone carriers, internet, and third-party AI and telephony providers, and can be affected by outages, call volume, poor connections, or AI errors (including misheard words, wrong information, or missed bookings). Agents are not an emergency service. Agents are instructed to tell callers reporting emergencies to call 911. You should keep your own backup for critical calls and review summaries promptly.
6. Your responsibilities
- Your callers' consent and notices. You are responsible for giving any notices and obtaining any consents your callers or customers require, including for call recording (for example, all-party-consent states), AI interaction, data collection, and text messages, and for your own privacy policy.
- Give us accurate business information (services, hours, prices, policies) and tell us about changes. You approve your Agent's script and are responsible for the information it gives out based on what you provided.
- You are responsible for how you use call data and for complying with laws that apply to your business (including HIPAA, if applicable — tell us before go-live; we will not handle protected health information without a separate written agreement).
- Keep your account access secure.
7. Acceptable use
You won't use the service to: break any law; make robocalls or outbound calls/texts without required consent (including under the TCPA); impersonate a person or pretend an Agent is human; collect payment card numbers or other sensitive data by phone; harass, deceive, or defraud anyone; send spam; infringe others' rights; or interfere with or reverse-engineer the service. We may suspend or end service for violations.
8. SMS / text messaging terms
If you or your callers opt in to texts from Timberline Voice or an Agent (for example, booking links or follow-ups): message frequency varies; msg & data rates may apply; reply STOP to unsubscribe and HELP for help, or contact jodyp@timberlinevoice.com / (719) 496-4633. Carriers are not liable for delayed or undelivered messages. Consent to receive texts is not a condition of purchase. Texting is available after carrier (A2P 10DLC) registration is approved. Clients must have proper consent before we send texts on their behalf.
9. Data and privacy
Our Privacy Policy explains how we handle data. For your callers' data, you are the controller and we are your processor: we use it only to provide the service to you and as you instruct, share it only with the subprocessors listed in our Privacy Policy (xAI, Twilio, Stripe, Google, Cloudflare), and help you answer privacy requests. You own your business data and call content; you grant us permission to use it to run and improve your service. We may use de-identified, aggregate data to improve our service.
10. Third-party services
The service relies on third-party providers. We aren't responsible for their outages or changes, and their own terms may apply.
11. Intellectual property
We own the service, our scripts, templates, prompts, and know-how. You own your business name, logos, and content. During your subscription you may use your Agent for your business.
12. Disclaimer
Except as expressly stated, the service is provided "as is" and "as available," without warranties of any kind, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent the law allows.
13. Limitation of liability
To the fullest extent the law allows: we are not liable for lost profits, lost revenue, lost jobs or customers, missed calls or appointments, or any indirect, incidental, special, consequential, or punitive damages, and our total liability for any claim is limited to the amount you paid us in the 3 months before the claim. Some laws don't allow these limits, so they apply only as far as permitted.
14. Indemnity
You'll defend and reimburse us for claims, fines, and costs arising from your callers' consent and notice obligations, your content or instructions, your texting or calling practices, or your breach of these Terms or the law.
15. Suspension and termination
Either party may end service by cancelling as above. We may suspend or terminate for non-payment, violations, or legal risk. On termination, we stop your Agent and delete your call data per our retention schedule; you can request an export within 30 days.
16. Governing law and disputes
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in El Paso County, Colorado, and both parties consent to that venue. Please contact us first. Most issues can be solved with a phone call.
17. General
These Terms (plus the Privacy Policy and any order) are the whole agreement. If any part is unenforceable, the rest still applies. We may update these Terms with notice by email or on our site; continued use means acceptance. You may not assign these Terms without our consent.
